1. Agreement to These Terms

These Terms of Service (“Terms”) are a binding agreement between you and Lead Skills, LLC (“Lead Skills,” “we,” “us,” or “our”), operator of the website hardmoneylendersmiamifl.com under the brand Hard Money Lenders of Miami (the “Site”). By accessing or using the Site, submitting an inquiry, or otherwise interacting with our service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

2. Our Role: Lead Generation Service

Hard Money Lenders of Miami is a lead-generation service. We connect borrowers who submit inquiries through the Site with one or more participating hard money lenders who may be able to provide financing.

We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, loan documents, rates, fees, funding timelines, and servicing are the sole responsibility of the participating lender. A current list of participating lenders is available upon request.

3. No Offer or Solicitation

Nothing on the Site constitutes an offer to lend, a commitment to lend, a solicitation of a loan application, or an offer of any specific rate, term, or loan product. Descriptions of loan types, ranges, and timelines reflect programs typically offered by participating lenders and are provided for informational purposes only. Actual rates, terms, fees, and availability vary by lender and are subject to change without notice. Not all applicants will qualify.

4. Eligibility

To use the Site and submit an inquiry, you must be at least 18 years old and legally able to enter into a contract. You agree to provide accurate, current, and complete information in any inquiry and to update it as needed. You may not submit inquiries on behalf of another person without their authorization.

5. Your Consent to Be Contacted

By submitting the contact form and checking the consent box, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry.

Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You can opt out at any time by replying STOP to any text or by calling 305-928-2678. You can request a current list of participating lenders at any time by contacting us.

6. Equal Opportunity

We connect borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree that you will not:

• submit false, misleading, or fraudulent information;
• submit inquiries using automated scripts, bots, or scrapers;
• interfere with or disrupt the Site, its servers, or the networks connected to the Site;
• attempt to gain unauthorized access to the Site, to user accounts, or to any related systems;
• use the Site to transmit viruses, malware, or other harmful code, or to harass, harm, or defraud any person;
• copy, reproduce, or scrape Site content except as permitted by these Terms or applicable law.

8. Intellectual Property

The Site, including its text, graphics, logos, images, and software, is owned by or licensed to Lead Skills and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use. All other rights are reserved.

9. Third-Party Links and Services

The Site may include links to, or interactions with, third-party websites or services, including participating lenders. We do not control and are not responsible for the content, privacy practices, or conduct of third parties. Your use of third-party services is subject to the terms and privacy policies of those third parties, and we encourage you to review them.

10. Disclaimers

The Site and all content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Lead Skills disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation. We do not warrant that you will be matched with a lender, that any lender will contact you, that any loan will be offered, or that any loan terms will be available.

11. Limitation of Liability

To the fullest extent permitted by law, Lead Skills and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost data, or loss of goodwill, arising out of or in connection with your use of the Site or any interaction with a participating lender, whether based in contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages. Our aggregate liability to you for any claim arising out of these Terms or the Site will not exceed one hundred U.S. dollars (US $100).

12. Indemnification

You agree to defend, indemnify, and hold harmless Lead Skills and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your inquiries, your breach of these Terms, or your violation of any law or the rights of a third party.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. You agree that any action arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction and venue in those courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes will be identified by a reasonable means. Your continued use of the Site after an update means you accept the revised Terms.
